On the 26th July, 1922, H.M, Office of Works, Lendon, instructed Mr. Bradley, H.M. Architect Shanghai, to confer with the Government of Hongkong as to the leasing of the Post Office Buildings at Shanghai.
In these instructions it was said:- "The rent will presumably be apportioned between the *Office of Works and the Hongkong Government on values of "land and buildings respectively, and a rental should be "recovered for the site from the Chinese Post Office or the "Hongkong Government."
On September 26th, 1922, Mr. Bradley informed the Officer Administering the Government of Hongkong of these instructions and consulted him as to the leasing of the Post Office Buildings at Shanghai.
It is to be noted that on the determination of the Jesses "any buildings or structure" should, in strict law, belong to the lessor; but this right has, I think, been waired by the acquiescence of the Commissioners in the valuation of the buildings made in 1910 at the instance of the Government of Hongkong, as above referred to.
On the facts above stated, I am of opinion that the sole remaining interest of the Government of Hongkong in the Post Office at Shanghai is the value of the buildings erected by that Government and, until payment thereof, such portion of any rent obtained for the temporary occupation of the premises as may be attributable to their use as distinct from the use of the site whereon they stand, (a somewhat difficult matter to calculate).
